Terms of Service

These Terms of Service ("Terms") govern your access to and use of myshowerestimate.com (the "Service"), operated by Michael, sole trader based in Athens, Greece ("we," "us," or "our"). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

My Shower Estimate is an independent referral service that helps UK homeowners obtain cost estimates for walk-in shower conversions and related home improvement projects, and connects them with installers and lead referral networks in their area.

We are not an installer. We do not perform installations, inspections, repairs, or any home improvement work ourselves. The installers and networks to whom we refer you are independent third parties. Any contract for actual home improvement services is solely between you and the chosen installer.

2. Eligibility

You must be at least 18 years old and a legal resident of the United Kingdom to use the Service. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Estimates are informational only

Estimates generated by our AI tool are based on the information you provide, photo analysis (if provided), and general market pricing data for your area. Estimates are educational and informational only. They are not binding quotes, offers, or commitments by us or by any installer. Actual project costs depend on factors that can only be confirmed through an in-person inspection by a qualified installer, including but not limited to plumbing condition, structural issues, material selection, building regulations, and labour availability. All estimates include VAT at the prevailing rate (currently 20%).

We make no representation or warranty that any installer will offer to perform the work at, near, or even within the estimate range provided.

4. Your responsibilities

You agree to provide accurate, current, and complete information when using the Service. You agree to not:

· Use the Service for any unlawful or fraudulent purpose
· Submit false, misleading, or impersonating information
· Attempt to access, scrape, or interfere with the Service or its underlying infrastructure
· Submit anything other than a photo of your bathroom when prompted to upload an image
· Use the Service to harass, abuse, or harm another person
· Resell, repackage, or commercially exploit any part of the Service without our written consent

5. Communications consent

By submitting a request through our Service, you expressly consent to receive communications from us and from matched installers via email, phone, and SMS at the contact information you provide. You may opt out at any time by replying STOP to a text message, clicking unsubscribe in an email, or contacting us at info@myshowerestimate.com. Standard message and data rates from your carrier may apply.

6. Third-party installers and services

We do not employ, supervise, or control any installer or lead network we refer you to. We do not guarantee the quality, timeliness, pricing, registration status, insurance coverage, or workmanship of any installer. Any disputes arising from work performed by an installer are between you and that installer.

We make reasonable efforts to refer only installers who appear to hold appropriate trade certifications (Gas Safe, NICEIC, Part P) and public liability insurance, but we do not independently verify every credential and disclaim any liability for errors in installer representations.

Before engaging any installer, we recommend that you verify their certifications, insurance, references, and reviews; review the written contract carefully (including your rights under the Consumer Rights Act 2015); and never pay for the entire project upfront.

7. No financial advice

Any financing options or monthly payment estimates displayed on our Service are illustrative only. We are not a lender, broker, or financial advisor, and we are not authorised by the FCA. Actual loan terms, interest rates, and approval depend on your credit and the lender. You should consult a qualified financial advisor before making any borrowing decisions.

8. Intellectual property

The Service, including all content, design, code, trademarks, and branding, is owned by My Shower Estimate or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

By uploading a photo of your bathroom, you grant us a non-exclusive, royalty-free licence to use the photo solely for the purpose of providing the Service to you (including processing it through our AI estimator and sharing it with matched installers as part of your project request).

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

We do not warrant that the Service will be free of errors, that estimates will be accurate, that installers will respond, or that any specific outcome will result from using the Service. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable consumer protection law (including the Consumer Rights Act 2015).

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR ANY WORK PERFORMED BY AN INSTALLER REFERRED THROUGH THE SERVICE.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed one hundred pounds (£100). Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

11. Indemnification

You agree to indemnify, defend, and hold harmless My Shower Estimate, its operator, and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your interactions with any installer referred through the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

13. Governing law and disputes

These Terms are governed by the laws of England and Wales for UK users. Any dispute arising from or related to the Service or these Terms shall be resolved in the courts of England and Wales, except where prohibited by applicable consumer protection law in your jurisdiction. Nothing in these Terms affects your statutory rights as a UK consumer.

14. Changes to these Terms

We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
